ഒരു സാധാരണ പൗരനെപ്പോലെ വേഷം ധരിച്ച ഒരാൾ നിങ്ങളെ നിരീക്ഷിക്കുന്നു. കുറച്ചുസമയം കഴിഞ്ഞ് അയാൾ നിങ്ങളോട് പേര് ചോദിക്കുന്നു; വാഹനം നിർത്താൻ ആവശ്യപ്പെടുന്നു; ബാഗ് പരിശോധിക്കാൻ ശ്രമിക്കുന്നു; ഒരുപക്ഷേ നിങ്ങളെ ചോദ്യം ചെയ്യുകയും ചെയ്യുന്നു.
അപ്പോഴാണ് നിങ്ങൾ അറിയുന്നത് — അയാൾ ഒരു പൊലീസ് ഉദ്യോഗസ്ഥനാണ്.
അവിടെ ഒരു അടിസ്ഥാന ഭരണഘടനാ ചോദ്യം ഉയരുന്നു:
കുറ്റാന്വേഷണത്തിന്റെ ആവശ്യത്തിനായി പൊലീസ് തന്റെ ഔദ്യോഗിക തിരിച്ചറിയൽ മറച്ചുവയ്ക്കുന്നത് എത്രത്തോളം നിയമാനുസൃതമാണ്? ആ മറവ് ഉപയോഗിച്ച് ഒരു പൗരന്റെ സ്വാതന്ത്ര്യത്തിലേക്ക് ഇടപെടാൻ തുടങ്ങുന്ന നിമിഷം നിയമം എന്താണ് ആവശ്യപ്പെടുന്നത്?
കേരളത്തിൽ സാധാരണയായി “Shadow Police” എന്ന് വിളിക്കപ്പെടുന്ന സംവിധാനത്തെക്കുറിച്ചുള്ള ശരിയായ നിയമചർച്ച ആരംഭിക്കേണ്ടത് ഇവിടെ നിന്നാണ്.
ഈ വിഷയത്തിൽ രണ്ട് അതിരുകടന്ന നിലപാടുകളും ഒഴിവാക്കണം.
“സിവിൽ വേഷത്തിലുള്ള എല്ലാ പൊലീസ് പ്രവർത്തനവും ഭരണഘടനാവിരുദ്ധമാണ്” എന്നത് ശരിയല്ല.
അതുപോലെ, “കുറ്റാന്വേഷണമാണ് ലക്ഷ്യം; അതിനാൽ Shadow Police എന്ത് ചെയ്താലും നിയമാനുസൃതമാണ്” എന്നതും ശരിയല്ല.
യഥാർത്ഥ നിയമചോദ്യം ഇതാണ്:
Covert policing എവിടെ അവസാനിക്കുന്നു? Coercive State power എവിടെ തുടങ്ങുന്നു?
ആ അതിർത്തിയിലാണ് ഭരണഘടന നിലകൊള്ളുന്നത്.
‘Shadow Police’ എന്ന പേരിൽ ഒരു പ്രത്യേക statutory police force ഉണ്ടോ?
Kerala Police Act, 2011-ൽ “Shadow Police” എന്ന പേരിൽ പ്രത്യേകം നിർവചിക്കപ്പെട്ട rank, cadre അല്ലെങ്കിൽ statutory police force ഇല്ല.
എന്നാൽ അതുകൊണ്ട് “Shadow Police” എന്ന operational arrangement തന്നെ നിയമവിരുദ്ധമാണെന്ന് പറയാൻ കഴിയില്ല.
കേരള ഹൈക്കോടതിയുടെ വിധികളിൽ തന്നെ “shadow police team” എന്ന പ്രയോഗം കാണാം. State of Kerala v. Narendra Kumar എന്ന 2024-ലെ കേസിൽ കേരള പൊലീസ് രൂപീകരിച്ച shadow police team-ലെ ഉദ്യോഗസ്ഥരുടെ പങ്കിനെ കോടതി തെളിവിന്റെ ഭാഗമായി രേഖപ്പെടുത്തിയിട്ടുണ്ട്. അതുപോലെ Sivakumar v. Kerala State എന്ന കേസിലും shadow police നടത്തിയ interception പ്രോസിക്യൂഷൻ കേസിന്റെ ഭാഗമായി കോടതി പരിശോധിച്ചു.
2026 ഫെബ്രുവരിയിൽ കൊച്ചിയിലെ സ്വകാര്യ ബസുകളിലെ ട്രാഫിക് നിയമലംഘനങ്ങളും മയക്കുമരുന്ന് ഉപയോഗവും കണ്ടെത്തുന്നതിനായി shadow police officers-നെ വിന്യസിക്കുന്നതായി Kochi City District Police Chief കേരള സംസ്ഥാന മനുഷ്യാവകാശ കമ്മീഷനെ അറിയിച്ചതായും റിപ്പോർട്ട് ചെയ്യപ്പെട്ടു.
അതായത് “Shadow Police” എന്നത് ഒരു statutory designation എന്നതിനേക്കാൾ plain-clothes/covert policing-ന്റെ operational description എന്നാണ് കാണേണ്ടത്.
ഇവിടെയാണ് ആദ്യ നിയമപരമായ വ്യത്യാസം.
പേരിന് നിയമത്തിൽ പ്രത്യേക സ്ഥാനം ഇല്ലാതിരിക്കുക എന്നതും, ആ പേരിൽ പ്രവർത്തിക്കുന്ന യഥാർത്ഥ പൊലീസ് ഉദ്യോഗസ്ഥർക്ക് നിയമപരമായ അധികാരമില്ല എന്നതും ഒരേ കാര്യമല്ല.
യൂണിഫോം ധരിക്കാത്ത പൊലീസ് ഉദ്യോഗസ്ഥൻ നിയമവിരുദ്ധനാണോ?
അല്ല.
Kerala Police Act-ലെ Section 43 ഈ വിഷയത്തിൽ നിർണായകമാണ്.
Section 43(1) പൊലീസ് യൂണിഫോം distinctive, exclusive, easily identifiable ആയിരിക്കണമെന്ന് പറയുന്നു. എന്നാൽ Section 43(2) State Police Chief-ന് ഏതെല്ലാം duties-ൽ uniform നിർബന്ധമായും ധരിക്കണം, ഏതിൽ optional ആകാം, ഏതിൽ ധരിക്കേണ്ടതില്ല എന്നത് നിർണ്ണയിക്കാൻ അധികാരം നൽകുന്നു.
അതുകൊണ്ട്:
Plain clothes ≠ illegal policing.
Criminal investigation, narcotics operations, organised crime detection, intelligence gathering, surveillance, decoy operations എന്നിവയിൽ ഒരു ഉദ്യോഗസ്ഥന്റെ identity ആദ്യഘട്ടത്തിൽ വെളിപ്പെടുത്തുന്നത് തന്നെ operation പരാജയപ്പെടുത്താൻ ഇടയാക്കാം.
നിയമം ഈ യാഥാർത്ഥ്യം അംഗീകരിക്കുന്നു.
പക്ഷേ അവിടെ നിന്ന് മറ്റൊരു നിർണായക വാക്യം കൂടി വായിക്കണം:
Uniform ഒഴിവാക്കാനുള്ള operational necessity, accountability ഒഴിവാക്കാനുള്ള licence അല്ല.
ഒരു പൊലീസ് ഉദ്യോഗസ്ഥന് ചില സാഹചര്യങ്ങളിൽ തന്റെ presence മറച്ചുവയ്ക്കാം.
പക്ഷേ സംസ്ഥാനത്തിന്റെ coercive power ഉപയോഗിക്കുമ്പോൾ നിയമം ആവശ്യപ്പെടുന്ന ഉത്തരവാദിത്തം മറച്ചുവയ്ക്കാൻ കഴിയില്ല.
Observation covert ആയിരിക്കാം; coercion നിയമത്തിന്റെ വെളിച്ചത്തിലായിരിക്കണം
പൗരനോട് “നിങ്ങൾ ആരാണ്?” എന്ന് ചോദിക്കുന്ന പൊലീസിനോട് പൗരനും “നിങ്ങൾ ആരാണ്?” എന്ന് ചോദിക്കാമോ?
State asks for identity; State must itself remain identifiable when exercising that statutory power.
ഒരു suspect-നെ അകലെ നിന്ന് നിരീക്ഷിക്കുന്നത് ഒരു കാര്യമാണ്.
ഒരു criminal network-ന്റെ movements പരിശോധിക്കുന്നത് മറ്റൊരു കാര്യമാണ്.
പക്ഷേ അതേ ഉദ്യോഗസ്ഥൻ ഒരു പൗരനോട് വാഹനം നിർത്താൻ ആവശ്യപ്പെടുമ്പോൾ, personal details ചോദിക്കുമ്പോൾ, bag പരിശോധിക്കുമ്പോൾ, സ്വകാര്യ സ്ഥലത്തേക്ക് പ്രവേശിക്കുമ്പോൾ, movement നിയന്ത്രിക്കുമ്പോൾ, custody-യിൽ എടുക്കുമ്പോൾ, search നടത്തുമ്പോൾ, അറസ്റ്റ് ചെയ്യുമ്പോൾ — State power ഒരു പുതിയ നിയമഘട്ടത്തിലേക്ക് പ്രവേശിക്കുന്നു.
അവിടെ surveillance മാത്രം ഇല്ല.
Authority is being exercised over a citizen.
അതാണ് constitutional turning point.
അതുകൊണ്ട് ഒരു അടിസ്ഥാന തത്വം ഇങ്ങനെ പറയാം:
Observation may remain covert. Coercive authority cannot become legally anonymous.
Kerala Police Act-ലെ Section 36 അതിന് വളരെ പ്രസക്തമായ മറുപടിയാണ് നൽകുന്നത്.
Sufficient reasons ഉണ്ടെങ്കിൽ Police Officer-ന് ഒരാളുടെ personal details ആവശ്യപ്പെടാം. എന്നാൽ Section 36(3) identity verification വേണമെന്ന ഒറ്റ കാരണത്താൽ ഒരാളെ അറസ്റ്റ് ചെയ്യാനോ custody-യിൽ വയ്ക്കാനോ movement നിയന്ത്രിക്കാനോ പാടില്ലെന്ന് വ്യക്തമാക്കുന്നു.
അതിലും ശ്രദ്ധേയമാണ് Section 36(4).
ഈ Section പ്രകാരമുള്ള authority ഉപയോഗിക്കുന്ന Police Officer identity badge/card മറ്റുള്ളവർക്ക് കാണാവുന്ന വിധത്തിൽ ധരിക്കണം; ആവശ്യപ്പെട്ടാൽ official identity record കാണിക്കുകയും വേണം.
ഇതൊരു ചെറിയ procedural provision മാത്രമല്ല.
ഇതിൽ ഒരു വലിയ constitutional philosophy ഉണ്ട്:
അതായത്, ഒരു പൊലീസ് ഉദ്യോഗസ്ഥൻ intelligence gathering-ന്റെ ഘട്ടത്തിൽ anonymous ആയിരിക്കാം. എന്നാൽ Section 36 പ്രകാരം നിങ്ങളുടെ personal identity ആവശ്യപ്പെടുന്ന authority പ്രയോഗിക്കുമ്പോൾ നിയമം തന്നെയാണ് അദ്ദേഹത്തിനും തിരിച്ചറിയൽ ബാധ്യത സൃഷ്ടിക്കുന്നത്.
Arrest ആരംഭിക്കുന്നിടത്ത് ‘Shadow’ അവസാനിക്കണം
ഒരു പൗരന്റെ liberty നേരിട്ട് നഷ്ടപ്പെടുത്തുന്ന State action ആണ് arrest.
അതുകൊണ്ടാണ് സുപ്രീംകോടതി D.K. Basu v. State of West Bengal, (1997) 1 SCC 416, എന്ന ചരിത്രപ്രധാന വിധിയിൽ arrest നടത്തുകയും interrogation കൈകാര്യം ചെയ്യുകയും ചെയ്യുന്ന പൊലീസ് ഉദ്യോഗസ്ഥർ accurate, visible and clear identification/name tags ധരിക്കണമെന്നും, ഉദ്യോഗസ്ഥരുടെ particulars രേഖപ്പെടുത്തണമെന്നും നിർദ്ദേശിച്ചത്.
ഇന്ന് ആ principle Bharatiya Nagarik Suraksha Sanhita, 2023-ലെ Section 36-ൽ statutory form-ൽ പ്രതിഫലിക്കുന്നു.
Arrest ചെയ്യുന്ന Police Officer തന്റെ പേര് എളുപ്പം തിരിച്ചറിയാൻ കഴിയുന്ന വിധത്തിൽ accurate, visible and clear identification വഹിക്കണം. Arrest memorandum തയ്യാറാക്കുകയും, അതിന് witness attestation ലഭിക്കുകയും, arrested person countersign ചെയ്യുകയും വേണം.
അതുകൊണ്ട്:
ഒരു പ്രതിയെ കണ്ടെത്തുന്നതുവരെ plain-clothes operation ആവാം.
പക്ഷേ arrest ആരംഭിച്ചശേഷം “ഞാൻ shadow police ആണ്; identity പറയേണ്ടതില്ല” എന്നൊരു പ്രത്യേക നിയമാവകാശം നിലവിലില്ല.
Arrest is not a shadow act.
It is a formal exercise of the coercive authority of the State.
Surveillance: സുപ്രീംകോടതി 1981-ൽ തന്നെ വരച്ച അതിർത്തി
Shadow policing-നെക്കുറിച്ചുള്ള ചർച്ചയിൽ ഏറ്റവും പ്രസക്തമായ സുപ്രീംകോടതി വിധികളിലൊന്നാണ് Malak Singh v. State of Punjab & Haryana, (1981) 1 SCC 420.
കുറ്റകൃത്യങ്ങൾ തടയുന്നതിനായി reputed bad characters, habitual offenders, potential offenders എന്നിവരെ discreet surveillance ചെയ്യേണ്ട സാഹചര്യം പൊലീസിന് ഉണ്ടാകാമെന്ന് സുപ്രീംകോടതി അംഗീകരിച്ചു.
Organised crime നേരിടാൻ suspects-നെ close watch ചെയ്യേണ്ടതിന്റെ practical necessity കോടതി തള്ളിക്കളഞ്ഞില്ല.
പക്ഷേ അതിനൊപ്പം കോടതി വരച്ച പരിധിയാണ് കൂടുതൽ പ്രധാനപ്പെട്ടത്.
Surveillance പൗരന്റെ fundamental freedoms-നെ “squeeze” ചെയ്യുന്നതോ dignity-യെ ബാധിക്കുന്ന തരത്തിൽ intrusive ആകുന്നതോ crime prevention-നുമായി ബന്ധമില്ലാത്തവരെ ഇഷ്ടാനുസരണം surveillance-ൽപ്പെടുത്തുന്നതോ അനുവദിക്കാനാവില്ലെന്ന് കോടതി വ്യക്തമാക്കി.
കോടതിയുടെ memorable formulation:
Surveillance must be “unobtrusive and within bounds.”
But Police do not have an unlimited constitutional licence to watch anyone, for any reason, in any manner, for any length of time.
Puttaswamy: സ്വകാര്യത State-ന്റെ ദയയല്ല — Fundamental Right ആണ്
Telephone tapping മുതൽ Pegasus വരെ: രഹസ്യാന്വേഷണത്തിനും Rule of Law ബാധകമാണ്
Secret investigation may sometimes be necessary. Secret power without legal safeguards is not.
Article 14: പ്രശ്നം ‘Shadow’ എന്ന പേരല്ല; arbitrary power ആണ്
ഇന്ന് “Shadow Police” സംബന്ധിച്ച ഏത് constitutional discussion-ന്റെയും starting principle ഇതാകണം.
Police may watch.
2017-ലെ ഒൻപത് ജഡ്ജിമാരടങ്ങിയ Constitution Bench K.S. Puttaswamy (Retd.) v. Union of India, (2017) 10 SCC 1 എന്ന വിധിയിൽ privacy ഒരു constitutionally protected fundamental right ആണെന്ന് ഉറപ്പിച്ചു.
Puttaswamy jurisprudence State intrusion-നെ പരിശോധിക്കാൻ മുന്നോട്ടുവയ്ക്കുന്ന അടിസ്ഥാന ഘടകങ്ങൾ വ്യക്തമാണ്: നിയമാധാരം ഉണ്ടായിരിക്കണം; legitimate State aim ഉണ്ടായിരിക്കണം; സ്വീകരിക്കുന്ന മാർഗം proportional ആയിരിക്കണം. പിന്നീട് Aadhaar വിധിയിലും ഈ proportionality framework വിശദമായി പ്രയോഗിക്കപ്പെട്ടു.
ഇവിടെ ഒരു തെറ്റിദ്ധാരണ ഒഴിവാക്കണം.
പൊതുസ്ഥലത്ത് ഒരു plain-clothes police officer ഒരാളെ നോക്കുന്നു എന്ന ഒറ്റ കാര്യം കൊണ്ട് Article 21 violation ഉണ്ടാകില്ല.
പക്ഷേ systematic tracking, profiling, recording, electronic monitoring, personal-data collection, prolonged targeting എന്നിവ constitutionally protected privacy-യിൽ യഥാർത്ഥ ഇടപെടൽ സൃഷ്ടിക്കുന്നുവെങ്കിൽ ഒരു ചോദ്യം ഉയരും:
What is the law authorising it?
അതിനു പിന്നാലെ:
What is the legitimate purpose?
അതിനുശേഷം:
Is the intrusion proportionate to that purpose?
“Police intelligence” എന്ന ഒറ്റ വാക്ക് ഈ constitutional enquiry അവസാനിപ്പിക്കുന്നില്ല.
People’s Union for Civil Liberties v. Union of India, (1997) 1 SCC 301 എന്ന telephone-tapping കേസിൽ സുപ്രീംകോടതി telephone conversation-ന്റെ privacy Article 21-ന്റെ protection-ൽപ്പെടുന്നതായി വ്യക്തമാക്കി. Telephone tapping serious invasion of privacy ആകുന്നതിനാൽ statutory conditions-നും procedural safeguards-നും വിധേയമായിരിക്കണമെന്ന് കോടതി നിർദേശിച്ചു.
ഇതിന്റെ അർത്ഥം intelligence activity മുഴുവൻ നിരോധിക്കണം എന്നല്ല.
അതിന്റെ constitutional message മറ്റൊന്നാണ്:
ഈ ആശയം technology-യുടെ കാലത്ത് കൂടുതൽ ശക്തമായി മുന്നോട്ടുവന്നത് Pegasus surveillance litigation-ലാണ്.
Manohar Lal Sharma v. Union of India, 2021 SCC OnLine SC 985 എന്ന കേസിൽ surveillance-നും privacy-ക്കും freedom of speech-നും തമ്മിലുള്ള ബന്ധത്തെ സുപ്രീംകോടതി വിശദമായി പരിശോധിച്ചു.
ഒരു വ്യക്തിക്ക് താൻ നിരീക്ഷിക്കപ്പെടുന്നുവെന്ന ബോധം തന്നെ തന്റെ അവകാശങ്ങൾ വിനിയോഗിക്കുന്ന രീതിയെ മാറ്റിയേക്കാം; self-censorship ഉണ്ടാകാം; പ്രത്യേകിച്ച് മാധ്യമസ്വാതന്ത്ര്യത്തിന്റെ പശ്ചാത്തലത്തിൽ chilling effect ഉണ്ടാകാമെന്ന് കോടതി നിരീക്ഷിച്ചു.
ഈ constitutional concern journalists-ൽ മാത്രം ഒതുങ്ങുന്നില്ല.
Political meetings, peaceful protests, student movements, trade-union activity, civil-society meetings, dissent, lawful public campaigns തുടങ്ങിയ മേഖലകളിൽ crime-related objective ഇല്ലാതെ individuals-നെ identify ചെയ്യാനും profile ചെയ്യാനും intimidate ചെയ്യാനും covert surveillance ഉപയോഗിക്കുന്നുവെങ്കിൽ Articles 19 and 21 നേരിട്ട് പ്രസക്തമാകും.
അതേസമയം എല്ലാ intelligence activity-യെയും chilling effect എന്ന് വിളിക്കാനും കഴിയില്ല.
Purpose, target, duration, method, information collected, statutory authority, safeguards — ഇവയെല്ലാം പരിശോധിച്ചേ constitutional answer കണ്ടെത്താനാവൂ.
Article 14 equality before law മാത്രമല്ല സംരക്ഷിക്കുന്നത്.
Arbitrary State action-നും constitutional scrutiny ഉണ്ട്.
അതുകൊണ്ട് “uniformed police-ന് accountability ഉണ്ട്; shadow police-ന് accountability ഇല്ല; അതിനാൽ എല്ലാ shadow policing-ഉം Article 14 violation ആണ്” എന്ന് പറയുന്നത് വളരെ വിശാലമായ വാദമായിരിക്കും.
പക്ഷേ മറ്റൊരു ചോദ്യം Article 14-ന്റെ കേന്ദ്രത്തിലേക്ക് നമ്മെ കൊണ്ടുപോകുന്നു:
ഒരാളെ surveillance-നായി തിരഞ്ഞെടുക്കാനുള്ള objective basis എന്താണ്? ആ surveillance-ന്റെ purpose എന്താണ്? അത് authorize ചെയ്തത് ആര്? എത്രകാലത്തേക്ക്? collected information എവിടെ സൂക്ഷിക്കുന്നു? ആരാണ് access ചെയ്യുന്നത്? എന്ത് supervisory review ഉണ്ട്? തെറ്റായി target ചെയ്യപ്പെട്ട പൗരന് എന്ത് remedy ഉണ്ട്?
ഈ ചോദ്യങ്ങൾക്ക് നിയമപരമായ standards ഇല്ലാതെ, discretion വ്യക്തിപരമായ ഇഷ്ടാനിഷ്ടമായി മാറുന്നിടത്താണ് arbitrariness എന്ന ഭരണഘടനാ പ്രശ്നം തുടങ്ങുന്നത്.
Democracy intelligence-നെ നിരോധിക്കുന്നില്ല.
Democracy unguided coercive discretion-നെയാണ് സംശയത്തോടെ കാണുന്നത്.
‘Shadow Police’ എന്നത് personation ആണോ?
അല്ല — ഒരു യഥാർത്ഥ പൊലീസ് ഉദ്യോഗസ്ഥൻ plain clothes-ൽ ഡ്യൂട്ടി ചെയ്യുന്നു എന്നതുകൊണ്ട് മാത്രം.
Bharatiya Nyaya Sanhita, 2023-ലെ Section 204 — Personating a Public Servant ബാധകമാകുന്നത് public servant അല്ലാത്ത ഒരാൾ താൻ അത്തരം office വഹിക്കുന്നുവെന്ന് അറിഞ്ഞുകൊണ്ട് വ്യാജമായി നടിക്കുകയും, ആ assumed character-ൽ official act ചെയ്യുകയോ ചെയ്യാൻ ശ്രമിക്കുകയോ ചെയ്യുന്ന സാഹചര്യത്തിലാണ്.
അതുകൊണ്ട് genuine Police Officer-ന്റെ undercover duty-യെ “personation” എന്ന criminal offence ആയി വിശേഷിപ്പിക്കുന്നത് നിയമപരമായി ശരിയല്ല.
അത് മറിച്ച് ഒരു പ്രധാന distinction മറച്ചുവയ്ക്കും.
നിയമപരമായി കൃത്യമായ ഭാഷ ഇതാണ്:
unlawful surveillance, lack of required identification, arbitrary interference, unlawful search, illegal detention, illegal arrest, abuse of statutory power.
നിയമവിമർശനം ശക്തമാകുന്നത് അതിശയോക്തിയിൽ നിന്നല്ല.
ശരിയായ നിയമപദം ശരിയായ സ്ഥലത്ത് ഉപയോഗിക്കുമ്പോഴാണ്.
കേരള ഹൈക്കോടതി നൽകുന്ന പ്രായോഗിക പാഠം: Sivakumar കേസ്
Private property-ലേക്ക് Shadow Police-ന് എപ്പോൾ പ്രവേശിക്കാം?
Plain clothes is not a search warrant.
“Shadow operation” is not a statutory blank cheque.
Sivakumar v. Kerala State, 2024:KER:79723, ഈ വിഷയത്തിൽ പ്രത്യേകം ശ്രദ്ധിക്കേണ്ട കേരള ഹൈക്കോടതി വിധിയാണ്.
പ്രോസിക്യൂഷൻ കേസനുസരിച്ച് shadow police ഒരു വ്യക്തിയെ സംശയത്തിന്റെ അടിസ്ഥാനത്തിൽ തടയുകയും അദ്ദേഹത്തിന്റെ bag-ൽ dry ganja കണ്ടെത്തുകയും ചെയ്തു. വിവരം Assistant Commissioner വഴി Sub Inspector-ന് ലഭിച്ചു. തുടർന്ന് statutory search, seizure, arrest നടപടികൾ നടന്നു.
എന്നാൽ NDPS Act Section 42(1) and 42(2) ആവശ്യപ്പെടുന്ന രീതിയിൽ ലഭിച്ച prior information രേഖപ്പെടുത്തുകയും superior officer-ന് copy അയക്കുകയും ചെയ്തതായി തെളിവില്ലെന്ന് ഹൈക്കോടതി കണ്ടെത്തി. Chain of custody/seal സംബന്ധിച്ച മറ്റ് material defects-ും ഉണ്ടായിരുന്നു. ഈ defects പരിഗണിച്ച് conviction കോടതി set aside ചെയ്തു.
ഈ വിധിയെ “Shadow Police നിയമവിരുദ്ധമാണെന്ന് ഹൈക്കോടതി പറഞ്ഞു” എന്ന് വായിക്കുന്നത് തെറ്റായിരിക്കും.
വിധിയുടെ യഥാർത്ഥ പാഠം കൂടുതൽ പ്രധാനപ്പെട്ടതാണ്:
Covert intelligence does not displace statutory procedure.
Shadow team-ൽ നിന്ന് ലഭിച്ച വിവരം പിന്നീട് NDPS search-ലേക്കോ seizure-ലേക്കോ arrest-ലേക്കോ മാറിയാൽ, ആ statutory action-ന് ബാധകമായ safeguards മുഴുവനും പാലിക്കേണ്ടതുണ്ട്.
“വിവരം ശരിയായിരുന്നു” എന്നത് മാത്രം procedural law ഒഴിവാക്കുന്നില്ല.
Rule of Law-ന്റെ അർത്ഥം അതാണ്.
Plain clothes ധരിച്ചിട്ടുണ്ടെന്ന ഒറ്റ കാരണത്താൽ ഒരു Police Officer-ന് സ്വകാര്യ premises-ലേക്ക് unlimited access ലഭിക്കുന്നില്ല.
Kerala Police Act Section 37 പ്രകാരം private place-ലേക്ക് പ്രവേശിക്കുന്നതിന് Police Officer-ന് “good and sufficient reasons” ഉണ്ടായിരിക്കണം; അതിന് അദ്ദേഹം accountable and responsible ആയിരിക്കണം. Custom, decency, privacy, propriety എന്നിവ പരിഗണിക്കണമെന്നും, സാധ്യമായിടത്ത് premises-ന്റെ ചുമതലയുള്ള വ്യക്തിയുടെ cooperation and consent നേടാൻ ശ്രമിക്കണമെന്നും provision പറയുന്നു.
ഇതിനുപുറമേ criminal search ആണെങ്കിൽ BNSS, NDPS Act അല്ലെങ്കിൽ ബന്ധപ്പെട്ട special statute നൽകുന്ന പ്രത്യേക safeguards ബാധകമായേക്കാം.
അതുകൊണ്ട്:
Police action record ചെയ്യാനുള്ള പൗരന്റെ അവകാശം
Kerala Police Act-ന്റെ Section 33 കേരളത്തിലെ police accountability framework-ൽ ശ്രദ്ധേയമായ provision ആണ്.
Police സ്വന്തം duty-കളുടെ audio/video/electronic record സൂക്ഷിക്കാമെന്ന് Section 33(1) പറയുന്നു.
അതിലും പ്രസക്തമായി, Section 33(2) അനുസരിച്ച് public അല്ലെങ്കിൽ private place-ൽ നടക്കുന്ന Police action/activity lawfully audio, video അല്ലെങ്കിൽ electronically record ചെയ്യുന്നതിൽ നിന്ന് ഒരു member of the public-നെ Police Officer തടയരുത്.
“Lawfully” എന്ന വാക്ക് പ്രധാനമാണ്. Investigation obstruct ചെയ്യുക, prohibited area-യിലേക്ക് കടക്കുക, മറ്റൊരാളുടെ independent privacy rights ലംഘിക്കുക തുടങ്ങിയ കാര്യങ്ങൾ ഇതിലൂടെ സ്വതവേ നിയമാനുസൃതമാകുന്നില്ല.
പക്ഷേ underlying legislative principle വ്യക്തമാണ്:
Police power is not designed to be immune from lawful public documentation.
Shadow policing-നെക്കുറിച്ചുള്ള accountability debate-ൽ ഇത് അതീവ പ്രസക്തമാണ്.
Police action-ന്റെ കാരണം ചോദിക്കാൻ കഴിയുമോ?
Kerala Police Act Section 32 മറ്റൊരു പ്രധാന safeguard നൽകുന്നു.
Police action ഒരാളുടെ body, property അല്ലെങ്കിൽ reputation-നെ adversely ബാധിച്ചാൽ, ആ വ്യക്തിക്കോ representative in interest-നോ ആ action-ന്റെ reason അറിയാനുള്ള അവകാശം provision അംഗീകരിക്കുന്നു.
അത്തരം action നടത്തുമ്പോൾ, സാഹചര്യത്തിൽ reasonably practicable ആയ പരിധിയിൽ Police Officer തന്റെ action-ന്റെ record സൂക്ഷിക്കണമെന്നും നിയമം പറയുന്നു.
Ongoing investigation, trial, State security എന്നിവയെ ബാധിക്കുന്ന സാഹചര്യങ്ങളിൽ വിവരമറയ്ക്കുന്നതിനുള്ള exception ഉണ്ട്.
ഇതിൽ നിന്ന് ഒരു Rule of Law principle രൂപപ്പെടുത്താം:
Police power may sometimes begin in secrecy; it cannot lawfully end in complete unaccountability.
Police abuse-നെതിരേ പുതിയ കുറ്റത്തിന്റെ പേര് കണ്ടെത്തേണ്ടതില്ല
Shadow policing-നെ വിമർശിക്കുമ്പോൾ “culpable abuse of police power” പോലുള്ള പുതിയ criminal terminology സൃഷ്ടിക്കുന്നതിനെക്കാൾ നിലവിലുള്ള നിയമം പരിശോധിക്കുകയാണ് ശക്തമായ സമീപനം.
Kerala Police Act Section 114 Police Officer applicable legal provision, procedure, rule or regulation ലംഘിക്കുകയോ അവഗണിക്കുകയോ ചെയ്യുന്നതുൾപ്പെടെയുള്ള dereliction of duty കൈകാര്യം ചെയ്യുന്നു.
Section 115 duty-യുമായി ബന്ധപ്പെട്ട് threat/coercion ഉപയോഗിച്ച് bribe അല്ലെങ്കിൽ unauthorised benefit ആവശ്യപ്പെടുന്നതിനെ ശിക്ഷിക്കുന്നു.
Section 116 അതിലും നേരിട്ട് പ്രസക്തമാണ്. Lawful authority അല്ലെങ്കിൽ reasonable cause ഇല്ലാതെ unnecessary search, illegal seizure, illegal detention, illegal arrest, torture, inhuman violence, grave misconduct, malicious false implication തുടങ്ങിയ police acts ഈ provision കൈകാര്യം ചെയ്യുന്നു.
അതുകൊണ്ട് constitutional policing-ന്റെ ചോദ്യം:
പുതിയ കുറ്റത്തിന് പുതിയ പേര് നൽകണോ?
എന്നതല്ല.
നിലവിലുള്ള accountability provisions യഥാർത്ഥത്തിൽ പ്രവർത്തിക്കുന്നുണ്ടോ?
എന്നതാണ്.
Police Complaints Authority: നിയമം നൽകിയിരിക്കുന്ന institutional remedy
Kerala Police Act-ലെ Section 110 State Police Complaints Authority-യും District Police Complaints Authorities-യും സൃഷ്ടിക്കുന്നു.
Superintendent of Police rank-ലും അതിനുമുകളിലുമുള്ള ഉദ്യോഗസ്ഥരുടെ misconduct സംബന്ധിച്ച complaints State Authority പരിശോധിക്കുന്നു. മറ്റു ranks-നുമായി ബന്ധപ്പെട്ട ചില grave complaints-ും അതിന്റെ പരിധിയിലുണ്ട്. Deputy Superintendent of Police rank വരെ ഉള്ള officers-നെതിരെയുള്ള complaints പരിശോധിക്കാൻ district-level authority-യും Act നൽകുന്നു. Inquiry-ക്കുശേഷം departmental action, criminal-case registration എന്നിവയുമായി ബന്ധപ്പെട്ട recommendations നൽകാനുള്ള സംവിധാനവും Section 110-ൽ ഉൾപ്പെടുന്നു.
2026-ലെ V.V. Rajesh v. District Police Complaint Authority കേസിലും Kerala High Court ഈ institutional accountability mechanism-ന്റെ പ്രാധാന്യം വീണ്ടും ചർച്ച ചെയ്തു.
അതുകൊണ്ട് plain-clothes policing സംബന്ധിച്ച ഗുരുതര misconduct ആരോപണത്തിന്റെ answer എല്ലായ്പ്പോഴും street-level confrontation ആകേണ്ടതില്ല.
Rule of Law നൽകുന്ന വഴി documentation, complaint, independent scrutiny, judicial review എന്നിവയാണ്.
അപ്പോൾ Shadow Police നിരോധിക്കണമോ?
അതാണ് ഈ ചർച്ചയിലെ തെറ്റായ ചോദ്യം.
Organised crime, narcotics trafficking, human trafficking, extortion networks, violent offenders, terrorism, cyber-enabled offences തുടങ്ങിയ കുറ്റകൃത്യങ്ങൾ നേരിടാൻ covert policing ചിലപ്പോൾ നിർബന്ധമാണ്.
ഒരു undercover officer uniform ധരിച്ച് criminal gang-നെ പിന്തുടരണം എന്ന ആവശ്യം policing-ന്റെ യാഥാർത്ഥ്യത്തോട് പൊരുത്തപ്പെടുകയില്ല.
അതുകൊണ്ട് blanket prohibition ഒരു പരിഹാരമല്ല.
പക്ഷേ covert policing എന്ന പേരിൽ indiscriminate surveillance, political profiling, moral policing, unlawful detention, unidentified coercion, illegal searches, statutory safeguards ഒഴിവാക്കൽ, intimidation, unauthorized personal-data collection എന്നിവ സാധാരണ policing technique ആയി മാറിയാൽ അത് democratic policing-ന്റെ പരിധി വിട്ടുപോകും.
അതിനാൽ വേണ്ടത് abolition അല്ല — transparent legal regulation and accountable operational standards ആണ്.
കേരളത്തിന് ഒരു Plain-Clothes & Covert Policing Protocol ആവശ്യമുണ്ടോ?
ഉണ്ട് എന്നതാണ് ഈ ലേഖനത്തിന്റെ നിഗമനം.
Operational secrets പൊതുജനങ്ങൾക്ക് പ്രസിദ്ധീകരിക്കണമെന്നല്ല.
ഒരു narcotics operation-ന്റെ target ആരാണ്, police informer ആരാണ്, officers എവിടെ നിൽക്കും, surveillance technique എന്താണ് തുടങ്ങിയ വിവരങ്ങൾ മുൻകൂട്ടി public domain-ൽ നൽകുന്നത് policing അസാധ്യമാക്കും.
പക്ഷേ citizen safeguards themselves must not become secret.
Publicly knowable norms കുറഞ്ഞത് covert surveillance authorize ചെയ്യാനുള്ള competent level, objective grounds, permissible duration, supervisory review, record/audit trail, personal-data handling, identity disclosure ആവശ്യമായ stage, stop/search/arrest safeguards, women and children-നുള്ള protections, private-premises operations, complaint and review mechanism എന്നിവ വ്യക്തമാക്കണം.
Operational secrecy സംരക്ഷിക്കാം.
Constitutional accountability മറച്ചുവയ്ക്കേണ്ടതില്ല.
ഒരു plain-clothes officer നിങ്ങളെ സമീപിച്ചാൽ പൗരൻ എന്ത് ചെയ്യണം?
ആദ്യം confrontation ഒഴിവാക്കുക. Police officer-നെ physically obstruct ചെയ്യുകയോ സ്ഥിതി അപകടകരമാക്കുകയോ ചെയ്യുന്നത് പരിഹാരമല്ല.
Personal details ആവശ്യപ്പെടുന്ന statutory authority പ്രയോഗിക്കുന്ന സാഹചര്യമാണെങ്കിൽ Section 36(4)-ലെ identity requirement പ്രസക്തമാണോ എന്ന് ശാന്തമായി ചോദിക്കാം. Arrest ആണെങ്കിൽ BNSS Section 36-ലെ visible identification, arrest memo തുടങ്ങിയ safeguards ബാധകമാണ്.
സാഹചര്യം അനുവദിക്കുന്നുവെങ്കിൽ official identity കാണിക്കാൻ ആവശ്യപ്പെടാം; genuine doubt ഉണ്ടെങ്കിൽ ബന്ധപ്പെട്ട police station/control mechanism വഴി verification തേടാം. Police action lawfully record ചെയ്യുന്നതിന് Kerala Police Act Section 33(2) നൽകുന്ന protection ഓർക്കാം.
സംഭവത്തിന്റെ date, time, place, officers-ന്റെ identity, vehicle details, witnesses എന്നിവ പിന്നീട് രേഖപ്പെടുത്തുന്നത് grievance redressal-ന് സഹായകരമാണ്.
Illegal detention, assault, unlawful search, grave misconduct തുടങ്ങിയ ആരോപണം ഉണ്ടെങ്കിൽ Police Complaints Authority, competent superior police authority, Human Rights mechanism, criminal process, അല്ലെങ്കിൽ സാഹചര്യത്തിനനുസരിച്ച് constitutional court എന്നിവയിൽ remedy തേടാം.
Rights അറിയുക എന്നത് Police-നെ എതിർക്കുക എന്നല്ല.
അത് Police power-നും citizen liberty-ക്കും ഇടയിൽ നിയമം നിശ്ചയിച്ച അതിർത്തി അറിയുക എന്നതാണ്.
Shadow Police-നെക്കുറിച്ചുള്ള ശരിയായ ഭരണഘടനാ ചോദ്യം
അവസാന വാക്ക്
Unaccountable policing is not thereby lawful.
Indiscriminate surveillance is constitutionally suspect.
He does not thereby work outside the law.
Coercive State action must remain legally accountable.
Rule of Law-ൽ രഹസ്യാന്വേഷണം ഉണ്ടാകാം; രഹസ്യമായ ഉത്തരവാദിത്തമില്ലായ്മ ഉണ്ടാകരുത്.

ഈ ചോദ്യങ്ങൾക്ക് തൃപ്തികരമായ ഉത്തരമുണ്ടെങ്കിൽ covert policing Rule of Law-ന്റെ പരിധിക്കുള്ളിൽ പ്രവർത്തിക്കാം.
ഉത്തരമില്ലെങ്കിൽ “shadow” ഒരു policing technique എന്ന നിലയിൽ നിന്ന് മാറി unaccountable State power എന്ന പ്രശ്നമായി മാറുന്നു.
കേരളത്തിലെ Shadow Police സംബന്ധിച്ച ചർച്ചയിൽ രണ്ടുവശത്തേക്കും നീതി ചെയ്യണം.
പൊലീസിന് കുറ്റകൃത്യങ്ങൾ തടയാനും അന്വേഷിക്കാനും intelligence ശേഖരിക്കാനും effective tools വേണം.
അതുപോലെ പൗരന് privacy, dignity, personal liberty, freedom of expression, freedom of movement, due process എന്നിവയും വേണം.
ഈ രണ്ടിൽ ഒന്നിനെ ഇല്ലാതാക്കിയാൽ ഭരണഘടന വിജയിക്കുന്നില്ല.
അതിനാൽ:
Undercover policing may be lawful.
Surveillance may sometimes be necessary.
A Police Officer may sometimes work without a uniform.
Investigation may begin in secrecy.
അതിനാൽ കേരളം ഇന്ന് ചോദിക്കേണ്ട ചോദ്യം:
“Shadow Police ഉണ്ടാകാമോ?” എന്നതല്ല.
“Shadow Police എന്ന operational മറവിൽ State power ഉപയോഗിക്കുമ്പോൾ നിയമം, proportionality, identification, documentation, supervision, accountability, citizen remedies എന്നിവ എങ്ങനെ ഉറപ്പാക്കുന്നു?”
ആ ചോദ്യത്തിന് വ്യക്തവും പൊതുജനങ്ങൾക്ക് അറിയാവുന്നതുമായ മറുപടി നൽകുന്നിടത്താണ് democratic policing ശക്തമാകുന്നത്.
